Terms of Service

Charchy provides the following services:

• Social media automation for Instagram and Facebook
• AI-powered chatbot widgets for websites
• Email campaign management and delivery
• A unified inbox for customer communications
• A knowledge base (the Library) that Zhirmand answers from
• Connections to Telegram, Discord and email, and calls from the website chat

You must be at least 16 to use Charchy. If you use Charchy for a business, you confirm that you may act for that business, and these Terms apply to the business too.

All users must comply with the following email sending policies:

• Permission required — you may only send marketing email to recipients who have given you explicit consent, and you must be able to show when and how they gave it
• Unsubscribe mechanism — all marketing email must include a functional one-click unsubscribe link
• Accurate headers — email headers (From, To, Reply-To) must accurately identify the sender
• No misleading content — subject lines must accurately reflect email content
• Compliance — you must comply with every email and data-protection law that applies to you, such as CAN-SPAM and CASL

You agree not to:

• Send unsolicited bulk email (spam)
• Use purchased or scraped email lists
• Send email without proper opt-in consent
• Violate any applicable laws or regulations
• Impersonate another person or entity
• Transmit malware, viruses, or malicious code
• Attempt to bypass platform security measures
• Use the platform for any illegal purpose

Your business owns the content in its workspace — its conversations, contacts, Library and campaigns. Charchy processes it for you to provide the service, as our Privacy Policy (https://charchy.krd/legal/privacy) describes.

You are responsible for having a legal reason to collect your customers' data through Charchy and for telling them about it. Where the law requires it, you must tell callers that calls are recorded.

Zhirmand's answers and drafts are written by AI and can be wrong. You are responsible for what is sent from your workspace, including what Zhirmand sends on its own, so check drafts before you send them and set Zhirmand up to hand conversations to your team when it should.

Where the law requires it, you must tell your customers that they may be talking with AI. Do not use Zhirmand to make decisions that have legal or similarly important effects on people.

The AI services Charchy uses may not train on your data. Charchy may use your workspace's conversations, with names, email addresses, phone numbers and other identifiers removed, to improve Zhirmand, unless an owner or admin turns off Help improve Zhirmand in Settings → Organization → General. Facebook, Instagram and TikTok conversations are never used for this.

When you connect a Facebook Page or Instagram account to Charchy, you must have the right to manage it, and you remain responsible for following Meta's Terms, Platform Policies and Community Standards in everything sent from it through Charchy, including automated replies.

Charchy is not affiliated with, endorsed by, or sponsored by Meta. Facebook and Instagram are trademarks of Meta Platforms, Inc. Meta may change or limit its APIs at any time, which can change or stop features that depend on them.

When you connect a TikTok account to Charchy, you must own it or be authorized to manage it, and you remain responsible for following TikTok's Terms of Service and Community Guidelines in everything sent from it through Charchy, including automated replies.

Charchy is not affiliated with, endorsed by, or sponsored by TikTok. TikTok is a trademark of ByteDance Ltd. TikTok may change or limit its APIs at any time, which can change or stop features that depend on them.

Your first plan payment is covered by our money-back guarantee. If you set Charchy up and it still is not working for your business, you can ask for that payment back in full.

• Ask within 30 days of your first payment, by writing to support@charchy.krd or messaging our team, and tell us what is not working
• You must have set Charchy up: connected at least one channel (such as Instagram, a Facebook Page, Telegram or the website widget) and added information about your business for Zhirmand to answer from
• We send the refund within 7 days of your request, in full, as money rather than credit, to the way you paid or by bank transfer
• Problems caused by a temporary outage of a service Charchy connects to (such as Meta, Instagram, Telegram or our payment provider), or by your own account on such a service being restricted or banned, are not covered. If a feature we offered cannot work for your business at all, it is covered
• The guarantee covers each business's first plan payment once. A business that has already had this refund cannot get it again with a new account or workspace
• The refund does not depend on how much of the plan you used. Later payments and credit purchases are not refunded. Nothing renews on its own, so you are never charged for a period you did not choose to pay for
• Accounts suspended or terminated for breaking these Terms are not covered
• Once we refund the payment, the plan ends that day

We reserve the right to suspend or terminate your account if:

• You violate these Terms of Service
• Your email bounce rate exceeds acceptable thresholds
• Your complaint rate exceeds acceptable thresholds
• You engage in activities that harm our platform or other users
• You fail to maintain payment for services

The Platform and its original content, features, and functionality are owned by Charchy and are protected by international copyright, trademark, and other intellectual property laws.

To the maximum extent permitted by law, Charchy shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of, or inability to use, the Platform.

While we strive to maintain high availability, we do not guarantee uninterrupted access to the Platform. Scheduled maintenance and unexpected downtime may occur. We will make reasonable efforts to notify users of planned maintenance.

We reserve the right to modify these terms at any time. We will notify users of significant changes by email or platform notification. Continued use of the Platform after changes constitutes acceptance of the modified terms.

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles.
